1) DEFINITIONS
Unless expressly stated otherwise the following definitions shall apply to the terms used in these terms and conditions:
Prairie Rose Bars is the trading name of Prairie Rose Bars Ltd whose registered office is at The Old Post Office, 41-43 Market Place, Chippenham, Wiltshire, England, SN15 3HR. Registered in England & Wales, 25th February 2017 Company No. 10639888 (hereinafter referred to as "PRB").

By signing up to work or volunteer with PRB, you acknowledge that you have read, understood and agreed to abide by all the points outlined within this document.
By completing and submitting an application to work or volunteer with PRB you are agreeing to abide by the PRB:
1. Terms and Conditions.
2. Code of Conduct.
3. Paid Staff Contract or Volunteer Agreement.
By completing and submitting an application you are agreeing to the submission of your email address to the PRB database and PRB PAAM account notifications database until you ask to be removed or after 2 years following your last employment/volunteering.
By completing and submitting an application you are agreeing that any photographs; video; sound recordings taken of you or by you may be used by PRB and the clients of PRB for any promotional purposes.
By completing and submitting an application you are agreeing that for the safety of the general public prior to arrival on site your personal details may be passed to the police to allow for a Police National Computer (PNC) check and/or Criminal Records Bureau (CRB) check to be performed.
By completing and submitting an application you are agreeing that your contact details added to the PRB database so that you may be contacted in the future, until you ask to be removed or after 2 years following your last employment/volunteering.
By completing and submitting an application you are agreeing that if your references or your performance at work is deemed less than satisfactory by PRB you may be blacklisted and thus unable to apply for further positions with PRB.
When working as a casual worker or volunteer for PRB you are working under a fixed term contract represented by your paid staff contract or volunteer agreement. The specifics of positions with PRB vary dependent on the event and role. Any failure on the casual worker or volunteer’s part to meet with their terms of employment; the PRB Terms and Conditions; the PRB Code of Conduct; will result in forfeit of any remuneration and deposit paid.
3) BORDERS AND IMMIGRATION - PROVING YOUR RIGHT TO WORK AND VOLUNTEER IN THE UK.
To undertake unpaid voluntary work, as well as paid work in the UK, you have to have the right to work either through your citizenship or a work visa. Under the Immigration, Asylum and Nationality Act of 2006 PRB is required to check your right to work before you start working on the event site.
This means that before you can start working or volunteering with us, you will need to produce documentation to prove you have this right. Acceptable proof of your right to work/volunteer includes:
• A UK or European Economic Area/Swiss passport
• A non UK/EEA passport with a valid visa showing right to work
On your form there is a space where you can upload a scan or photo of your passport. If you choose to do this we will store the document on the highly secure PAAM servers. We will not share it with any third parties other than UK Borders
4) DEPOSITS.
To confirm and accept your position with PRB at your chosen event(s) you will need to pay a deposit of £200. Applicants who choose to volunteer at multiple festivals with PRB in the same year will pay only one deposit, which will be carried over until the end of your last event of the season.
Your deposit must be paid as an on-line deposit of funds into a specific account via Stripe. We will provide details of this account when we accept your application work with us.
Your deposit may be withheld or forfeited completely if you:
1. Fail to sign in and out from, or fail to complete any full shift allocated to you.
2. Turn up to shift under the influence of drugs and/or alcohol.
3. Breach the PRB Terms & Conditions.
4. Breach the PRB Code of Conduct.
Please note that it is each individual's personal responsibility to ensure they sign in and sign out of every shift worked. Failure to do so will lead us to assume that you did not present on time or failed to complete your shift and you will forfeit your deposit.
Your deposit will be returned (less a £5 admin fee) providing you have met the terms and conditions of your specified job role. Deposits will be refunded back to the original payment card within 7 days of the end of an event. If your card has been lost or cancelled, please contact us as soon as possible with your updated card details. PRB cannot be held responsible for deposit payments that are returned to lost or cancelled cards, and may charge an additional admin fee for payments that need to be reissued.
All deposit returns will be processed within a week but may take longer to arrive in your account, depending on your bank's processing times. It is your responsibility to check the amount you receive and raise any queries or objections regarding deductions by emailing info@prairierose.co.uk no later than 2 months after your final shift at the event. Any objections or queries raised after this date will not be considered.
5) EMPLOYMENT RIGHTS ACT.
The following information is a statement of the Terms and Conditions of employment under the employment rights act 1996.
1. You are required to carry out your roles and responsibilities as detailed in the job description and position specification.
2. Any previous employment with PRB or any other employer does not form part of a period of continuous employment. Each position is subject to a separate contract of service.
3. Your place of work will be the address of the event and is where you are required to work. Details will be given to you on confirmation of position.
4. Your employer's address is the PRB principal place of business.
5. Staff will be paid on the basis of an agreed rate per hour, shift, or event. This rate will be agreed with you at the confirmation of each position.
6. There are no enhancements to stated rates for Weekends or Public Holidays.
7. Staff are responsible for their own travel, accommodation and food expenses (unless otherwise stated).
8. Provision of meals or allowances are not automatically included and may vary between events. These are not negotiable and are awarded at the discretion of the company directors.
9. For paid staff, remuneration will be paid to you as agreed at the confirmation of a position. Payments are made in GBP by BACS to an account of the named individual member of staff within 2 weeks of completion of the event. For self-employed staff, an invoice must be received by PRB within 2 weeks of completion of the event. Personal invoices will require a current Unique Tax Reference (UTR).
6) HOURS OF WORK.
The hours of work /volunteering will be specific to each event and will be made clear on application.
Please note that shifts times are subject to change.
The PRB working week commences on Monday.
The time it takes you to sign-in and travel to and from your place of work is additional to your allocated shift.
You are expected to arrive on the event site with everything you need to support yourself until you leave the event site. This includes appropriate clothing for all weathers, food, money and general camping equipment. PRB is not responsible for the personal possessions of any PRB paid staff member or volunteer.
In the case of incapacity for work you will forfeit any allocated positions at current or future events and receive no remuneration. Termination of your paid staff contract or volunteer agreement for any reason may lead to a deduction or forfeit of your deposit. This is due to the nature of the positions being for a fixed period.
PRB does not operate any pension schemes to employees contracted for a fixed period.
Your casual worker or volunteer position is for a fixed term and expires at the end of each event.
Your casual worker or volunteer position is temporary and may be withdrawn at any time due to any of the following reasons:
I. PRB does not gain a contract of services at named event;
II. The named event does not take place or is cancelled;
III. You are in breach of the PRB Terms & Conditions or Code of Conduct.
If you are dissatisfied with any disciplinary decision you should apply in the first instance to your PRB line Manager. You should make your application by speaking to the PRB line Manager who will document your conversation.
If you have a grievance about your line management you should apply in the first instance to the PRB Company Director. You should make your application in writing to the PRB principal place of business.
7) CODE OF CONDUCT.
Any of the following including the aiding and abetting of others constitutes a breach of the PRB Terms and Conditions of casual worker contract and/or voluntary position.
1. Failure to comply with the PRB Terms and Conditions; Code of Conduct; and instructions of PRB clients.
2. Neglecting to complete a required task promptly and diligently, without sufficient cause.
3. Leaving a position without permission or without sufficient cause.
4. Making or signing any false statements, of any description.
5. Destroying, altering or erasing documents, records or electronic data without permission or through negligence.
6. Divulging matters confidential to PRB and/or its clients, either past or present, without permission.
7. Solicitation or receipt of gratuities or other consideration from any person, or failure to account for money or property received in connection with the business of PRB or PRB clients.
8. Incivility to persons encountered in the course of duties or misuse of authority in connection with the business of PRB or PRB clients.
9. Conduct in a manner likely to bring discredit to PRB a fellow employee, PRB clients, or PRB client's customers.
10. Reporting for duty under the influence of alcohol or restricted drugs, or use of these whilst on duty.
11. Failure to notify PRB immediately of any:
i. Indictment for any offence that may affect your work with PRB.
ii. Police caution or legal summons that may affect your work with PRB.
12. Permitting unauthorized access to premises; event site; place of work.
13. Not maintaining agreed standards of appearance; identification; and deportment whilst at work.
14. Causing a conflict of interest, directly or indirectly, engaging or participating in any other business activities that PRB, in its reasonable discretion, determines to be in conflict with the best interests of PRB without the written consent of PRB, which consent will not be unreasonably withheld.
8) CANCELLATION OR FAILURE TO ATTEND.
PRB have a 'cancellation deadline' for each event, which is 28 days before you are expected on-site. If you choose to cancel your position at an event with PRB after the cancellation deadline, you will forfeit your deposit.
If for any reason you need to cancel your volunteer position with us before the cancellation deadline, you can do so by notifying us directly at info@prairierose.co.uk and your deposit will be returned (minus a £15 admin fee) within 7 days of us receiving your cancellation.
Please be aware that for volunteers who have registered for multiple events in one year, your deposit will be automatically carried over between events (as described in SECTION 4) and the same cancellation deadline rules will apply for each event.
If you are unable to attend an event with us as previously agreed at the last minute due to illness or other unavoidable circumstance, please ensure that you contact us at info@prairierose.co.uk us to let us know as soon as possible. Under these circumstances we may ask you to provide documentary evidence, such as a doctor’s note. We fully appreciate that your reason for cancelling may be of a sensitive nature and hope you understand why it is sometimes necessary for us to ask for evidence. If you fail to attend a shift or event and do not notify us or respond to our requests, you are at risk of losing your deposit.
9) PAID STAFF & VOLUNTEER AGREEMENT.
1. I will be 18 years old or over on the first day of the first event.
2 . I have the right to work and volunteer in the UK.
3. I will represent PRB in a positive and appropriate way, fulfilling my role to the best of my ability in line with the briefing and training provided.
4. I will be onsite and available to work/volunteer on the days required of me as set out in my role profile.
5. I will arrive to shifts on time and participate fully for the period of time specified to me.
6. I understand that it is expressly forbidden to consume alcohol or drugs during or prior to a shift.
7. I understand that giving away drinks or intentionally undercharging is theft and will be treated as such.
8. I will read the PRB risk assessment for each event and adhere to the PRB Responsible Drinking Policy as laid out in the PRB Staff Handbook which will be available to me before each event.
9. I have read and understood that if my behaviour falls outside any of these standards it may lead to my eviction from the site and my deposit and/or wages being forfeited. PRB reserves the right to initiate this process without first giving a warning if a paid staff member or volunteer has clearly broken these Standards of Behaviour.
